i9 Intelligence vs. DocuSign

DocuSign is built to collect signatures, and it offers a free fillable Form I-9 template. Federal rules for electronic I-9s ask for more than a signature, including corrections on the same record and an audit trail you can hand to ICE. Employers who call us from DocuSign keep it for offer letters and run the I-9 in i9 Intelligence.

A signing tool and an I-9 system do different jobs

DocuSign's I-9 template is formatted like the USCIS form, and DocuSign records who signed and when. That covers the signature. Under 8 CFR 274a.2(e) through (i), an employer that completes I-9s electronically also needs controls against unauthorized changes, written documentation of the process, an indexing system, and a permanent record every time a form is created, changed, or corrected. DocuSign's own I-9 blog says electronic signing doesn't remove those obligations.

The December 2023 DOJ and ICE guidance on I-9 software spells out what that means day to day. Section 1 comes before Section 2, corrections are recorded on the form, everyone who changes it is identified, summary spreadsheets are available on request, and E-Verify follows the program's rules. A PDF template in a signing workflow leaves most of that for your team to build and document.

E-Verify and reverification

DocuSign doesn't connect to E-Verify, so employers who use it create each case at e-verify.gov, retype the I-9 data, and have to do it by the third business day after the employee starts work for pay. There's no reverification alert either, so an expiring work permit only gets caught if someone put it on a calendar. In i9 Intelligence the E-Verify case is submitted from the completed I-9, and reverification alerts go out at 180, 90, 60, and 30 days.

Fixing an I-9 after it's signed

Section 2 mistakes are common, and the fix belongs on the original form with a record of who changed it. DocuSign's help center says a completed envelope can't be corrected, so a fix turns into a new document sitting next to the old one. In i9 Intelligence, Section 2 corrections are made in the app and logged in the audit trail.

Remote Section 2

DocuSign can get a signature from anywhere, but someone still has to examine the new hire's documents, in person or by live video under the DHS alternative procedure, which requires E-Verify (USCIS). DocuSign doesn't handle that part. On i9 Intelligence, a manager or representative you choose completes Section 2 at no extra cost, or our US-based team does it by video.

Where DocuSign is stronger

Every comparison we publish includes this. If one of these matters most to you, DocuSign may be the better fit.

  • One signing workflow covers offer letters, policies, tax forms, and the I-9.
  • Plenty of new hires have signed with DocuSign before, so there's nothing new to learn.
  • For a very small employer hiring in person without E-Verify, the free template may be enough.

Keep DocuSign. Add i9 Intelligence.

DocuSign keeps offer letters and the rest of your signing while the Form I-9, E-Verify, and remote Section 2 run in i9 Intelligence, with every change recorded in one audit trail. Most clients we onboard are up and running within a week.

Common questions

Can you do Form I-9 in DocuSign?

You can collect I-9 signatures in DocuSign, and it offers a free fillable template. Whether that adds up to a compliant electronic I-9 depends on everything around the signature, meaning the controls, audit trail, indexing, and documentation required by 8 CFR 274a.2, plus E-Verify and reverification if you need them. The employer is responsible for all of it, whichever tool it uses.

Does DocuSign connect to E-Verify?

No. Employers who use DocuSign for the I-9 create each E-Verify case themselves at e-verify.gov and retype the information. i9 Intelligence submits the case from the completed I-9 and tracks any mismatch on the same record.

Is a DocuSign certificate of completion an I-9 audit trail?

It shows who signed and when, which helps. The federal rules for electronic I-9s go further and call for a permanent record whenever the form is created, changed, or corrected, plus documentation of the whole process. A correction made after the envelope is complete won't appear on that certificate at all.

Can we keep DocuSign and use i9 Intelligence?

Yes. Most employers keep DocuSign for offer letters and other documents and move the Form I-9 and E-Verify to i9 Intelligence, where each new hire gets a secure link to start Section 1 with no account or password.

What should we do with the I-9s already in DocuSign?

Keep them for the full retention period, or have us bring them into i9 Intelligence and audit them. The audit tells you which forms need corrections before an inspection does.
